Supreme Court issues Artificial Intelligence Guidelines

Over the new year, the Supreme Court released new guidelines for the use of Generative AI which will apply to proceedings in the Supreme Court, District Court, Magistrates Court, Youth Court, the Environment Resources and Development Court and the Court of Disputed Returns.

This followed a survey by then Chief Justice Kourakis in May 2025 and broad consultation with the profession. Read the Society’s response to the Survey here.

The Guidelines are comprehensive and include useful examples of ethical and responsible use of AI. They are accompanied by an information sheet for self-represented litigants, written in easily understood language and providing an explanation of the Harman undertaking, verification of legal sources, and examples of how to ask questions of AI to generate more relevant and accurate answers.

The guidelines for the use of Generative AI may be adopted by Tribunals or other South Australia Courts, and we await advice from those Tribunals and Courts as to their position in relation to the use of AI.
